The Partner Visa enables an Australian citizen, permanent resident or eligible New Zealand citizen to sponsor his/her partner to migrate to Australia. 

 

A partner includes a spouse and a de facto (opposite or same-sex) partner.

 

An application can be made by a partner who is located within Australia (subclasses 820/801) or outside Australia (subclasses 309/100).

 

If an application is approved, a temporary visa will be granted for a period of 2 years, after which the applicant becomes eligible for a permanent visa.  In some circumstances, an applicant may be eligible for a permanent visa without the 2 year temporary visa first.

 

You must be able to demonstrate that the relationship is genuine and ongoing and that each partner has a mutual commitment to a shared life together to the exclusion of all others.

 

For a married relationship, the marriage must be a legal marriage under Australian law.  For a de facto relationship, the parties must have been in the relationship for at least 12 months.  All applicants must also meet character and health requirements.

 

A subclass 801 or 100 permanent visa entitles the holder to all permanent resident benefits including healthcare, social security benefits and possible eligibility for citizenship.
